Proof Summary There is some confusion on the birth year of Benjamin McGinnis. With the evidence presented, it has been concluded that he was born in 1840, not 1838. According to the Magennis Family History, Benjamin was born in 1840. But according to his grave marker, he was born in 1838. These are both derivative sources so it is hard to say which one is accurate. The most compelling evidence that he was born in 1840 is that in every census he was recorded in, his age suggests an approximate 1840 birth year. The only exception is the 1880 Census, which suggests an 1837 birth year. Because recorded age tends to get less accurate as time goes by, one can explain that this census isn't as trustworthy as earlier censuses. For this reason, although not conclusive, Benjamin McGinnis was born in 1840, not 1838.
